On June 15, 2021, the Department of Industrial Relations, Division of Occupational Safety and Health ("the Division") submitted documentation to the Office of Administrative Law ("OAL") to commence an emergency rulemaking to define the term "normal consumption" used in Labor Code section 6403.3.

The Definition of Normal Consumption emergency regulation was adopted and filed with the Secretary of State on June 25, 2021. The regulation took effect on July 26, 2021.
