Rulemaking

The Board is proposing modifications to California Code of Regulations, title 8, sections 347, 359.1, 361.3, 372.2, and 373. These modifications will accomplish the following, without limitation: (1) they will shift the requirement that the employer provide copies of the appealed citations from the employer to the Division of Occupational Safety and Health (Division), making the appeal process simpler and more intuitive for employers; (2) they will allow attorneys licensed by the California State Bar, acting as an attorney of record for a party, to issue their own subpoenas in Board proceedings; (3) they will give Board staff five working days to process requests for subpoenas; and (4) they will repeal the automatic discovery provisions contained in section 372.9.
