Public Works Pre‐Qualification of Contractors
In 1999, the Legislature enacted a law that allows many public agencies to require licensed contractors that wish to bid on public works jobs to “pre-qualify” for the right to bid. The law authorizes such public agencies to adopt a pre-qualification system in accordance with Public Contract Code section 20101.
The Department of Industrial Relations developed the model pre-qualification questionnaire in 2000. The questionnaire, enhanced in 2018, now relates to the California Labor Commissioner’s enforcement objectives and helps awarding bodies fulfill their statutory obligations. The new Labor Commissioner’s Model Questionnaire is easy to use, customizable to suit the specific needs of each awarding body and meets all provisions of the law.
The Department of Industrial Relations encourages awarding bodies to adopt the new Labor Commissioner’s Model Questionnaire and create a more level playing field where law-abiding contractors can thrive and compete.
