Petitions - where to file

Filing of petitions for reconsideration, petition for removal

Except as provided in WCAB Rules 10865 and 10953 (or unless the party filing the petition or answer is part of an electronic filing trial group), petitions for reconsideration, removal, or disqualification and answers thereto may be filed with any district office of the Workers' Compensation Appeals Board* or with the office of the Appeals Board in San Francisco. However, duplicate copies of petitions or answers that filed with the district office shall not also be filed with any other district office or with the Appeals Board in San Francisco.

Petitions for reconsideration and answers thereto in "carve-out" cases (see Rule 10865) and petitions appealing Labor Code section 129.5(g) audit penalty assessments and answers thereto (see Rule 10953) shall be filed only with the office of the Appeals Board in San Francisco.

Petition for writ of review (See Labor Code Section 5950, et seq.)

A party aggrieved by a final decision of the Appeals Board may apply to the court of appeal for the appellate district in which the party resides for a writ of review.
