Senate Bill 1127

On September 29, 2022, the Governor signed into law Senate Bill 1127 (2021-2022 Reg. Sess.), which as codified at Labor Code section 5402, subdivision (e) provides: 

Upon appropriation by the Legislature, the Division of Workers’ Compensation shall identify and amend its existing data collection processes to include collection of the date on which the claimant is notified of acceptance, denial, or conditional denial of liability for a claim, consistent with this section.

As of today’s date, there is no change to the FROI/SROI reporting requirements because the Legislature has not yet authorized funding for the Division of Workers’ Compensation to update its data collection processes. 

The division uses the IAIABC EDI system to collect data about workers’ injuries and workers’ compensation claims; it maintains that data in the Workers’ Compensation Information System database (WCIS).  To collect the conditional denial date from reporting parties referenced in Labor Code section 5402, WCIS collection processes first must be upgraded to IAIABC EDI’s FROI/SROI release 3.1 (or later version).  

As soon as that upgrade has been implemented, the division will provide notice through both DWC Newslines and this webpage.
