Subject:     Advisory Committee to consider proposed amendments to General Industry Safety Orders (GISO), Section 5110 Repetitive Motion Injuries

The purpose of this letter is to notify you, as an interested party, of an ad hoc advisory committee to be convened by the Division of Occupational Safety and Health (Division) and the Occupational Safety and Health Standards Board (Board) in Sacramento, California on April 28, 2003. The advisory committee will consider proposed amendments to Title 8, GISO, Section 5110 regarding ergonomic hazards and the prevention of repetitive motion injuries. In addition to reviewing, commenting on, and proposing amendments to Section 5110, the advisory committee will consider administrative alternatives to improve enforcement of Section 5110 and explore the employer's obligation to address RMIs under Section 3203, Injury and Illness Prevention Program. As part of the advisory process the committee will review the documents referenced below, along with other relevant information, and staff will report back to the Board in May 2003. Although the Board relies primarily on the selected committee members, interested parties may attend the meeting and provide comments to the extent that time allows.

Background:

On February 20, 2003 the Board considered Petition 448 from the California Labor Federation proposing amendments to California Code of Regulations Title 8, Section 5110, Repetitive Motion Injuries. The Board's petition decision directed Board and Division staff to convene and co-chair an advisory committee to:

  • Consider the petitioner's recommended amendments to Section 5110 submitted to the Board on September 19, 2002
  • Review the record assembled during the Board's consideration of Petition 448
  • Consider administrative alternatives to improve enforcement of Section 5110
  • Explore the employer's obligation to address repetitive motion injuries under Title 8 Section 3203, Injury and Illness Prevention Program
  • Specifically review, comment on and propose amendments to Section 5110, including a draft proposal submitted by the Division in its evaluation of Petition 448
  • Report back to the Board within three months

Purpose of the Advisory Committee:

The purpose of the advisory committee process is to assist the Board in developing necessary and effective regulations. The advisory committee functions as a working group to provide input on the necessity for, and the structure of, proposed changes to regulations. The Board has used advisory committees for years as an effective method to reach consensus among affected parties (stakeholders).
