Article 4 Hearings
§232.53. Conclusion of Hearing; Time for Decision
(a) The hearing shall be deemed concluded and the matter submitted either upon
the completion of all testimony and post-hearing arguments or upon the expiration
of the last day for filing any post-hearing brief or other authorized submission,
whichever is later. Thereafter, the Administrator shall have 45 days within which
to issue a written decision affirming, modifying, or dismissing the Determination
of civil penalty or debarment.
(b) For good cause, the Hearing Officer may vacate the submission and reopen the
hearing for the purpose of receiving additional evidence or argument, in which
case the time for the Administrator to issue a written decision shall run from
the date of resubmission.
