Subarticle 1. General
§232.06. Access to Hearing Records.
(a) Hearing case records shall be available for inspection and copying by the
public to the same extent and subject to the same policies and procedures governing
other records maintained by the Department. Hearing case records normally will
be available for review in the office of the appointed Hearing Officer; provided
however, that a case file may be temporarily unavailable when in use by the appointed
Hearing Officer or by the Administrator or his or her designee.
(b) Nothing in this Rule shall authorize the disclosure of any record or exhibit
that is required to be kept confidential or is otherwise exempt from disclosure
by law or that has been ordered to be kept confidential by an appointed Hearing
Officer.
