Summary of SIERRA READY MIX - DAR


An employee inadequately trained to use a shovel to clean the belt rollers got the shovel caught between the belt and the roller. A supervisor de-energized the conveyor and the employee freed the shovel. The employee then began cleaning the roller by hand. The supervisor said he was going to re-energize the machine. The employee said "no." The supervisor didn't hear him and re-energized the machine. The employee was seriously injured when his hand and arm were caught between the belt and the roller. A serious violation of section 3314(a) was sustained. The ALJ's finding that the conveyor had to be capable of movement during the cleaning operation was affirmed. The evidence proves that the employee was not sufficiently trained to use the shovel as an extension tool and was exposed to the hazard. The supervisor could have known of the training deficiency. Serious physical harm was substantially probable
