Summary of Lakeside Veterinary Hospital - DAR


An employee was bitten by a cat on February 7, 1997 and received outpatient treatment for the bite that day. The employee was admitted to the hospital for surgery on February 8 and not released until February 14. The employer did not report the injury though it was aware on February 8 that the employee was hospitalized. The employer said it was not informed that the injury occurred at work. The Board found that employer could have inferred and should have resolved the doubt about the injury in favor of reporting it to the Division. The fact that the injured employee didn't testify at the hearing didn't invalidate the ALJ's findings since another percipient witness testified. A regulatory violation of section 342(a) was upheld.
