An employee was killed when a 7.5' diameter, 350 lb. reel flange he was rolling to an assembly point unaided fell over on him. The Division cited Employer for a violation of section 3328(e) [Machinery and equipment components shall be designed and secured...to prevent loosening and falling]. The Board held that section 3328(e) doesn't apply because the flange is a component of a product Employer manufactures, not machinery or equipment that employees in Employer's service use to manufacture reels--the subject of section 3328. Also the flange was not attached to anything so it was incapable of "loosening and falling." Other safety orders may have applied; if not, the Division could have issued a special order to Employer.
