Summary of Golden State Boring & Pipejacking, Inc. - Decision After Reconsideration

A door covering a soil ejector opening on an earth-boring machine was left open while the machine was operating and an employee was working next to the ejector. The employee's foot entered the ejector and his foot/leg was amputated by the revolving vanes (paddles). The Division cited Employer under section 3942(a), which states that guards shall be appropriate for the hazards involved and they shall be secured in place. The Board finds a violation because the door guarding the opening was not secured in place and because, in that condition, it was not appropriate protection from the hazard.
