Summary of Melkesian Ranch, Inc. – Denial of Petition for Reconsideration

The Division cited Employer for having an insufficient number of toilets at its vineyard, where a crew of 30 male and 30 female employees was working, and for inadequate maintenance of a drinking water facility. The ALJ affirmed both violations. Employer’s petition for reconsideration was based on its allegation that the Division’s investigating officer’s testimony was unbelievable. Employer’s allegations lacked the substance that the Board requires in order to grant relief. The petition contained numerous statements expressing general disagreement with the ALJ’s findings. The Board found that the ALJ’s findings were supported by the evidence because the ALJ specifically credited the inspector’s testimony over Employer’s and enunciated the reasons why.
