DWC warns pharmacies of Labor Code provisions regarding cash payments for prescriptions

DWC has issued an advisory letter to pharmacies in California that are or are considering requiring workers' compensation patients to pay in cash for their prescriptions. The letter points out that pharmacies accepting direct payment from injured workers are at risk of being in violation of Labor Code section 3751, subdivision (b). This Labor Code provision also provides monetary penalties for violation of the section. A copy of the letter is attached to this newsline.
