Does an employee report of an injury or illness establish the existence of the injury or illness for recordkeeping purposes ?

Answer
No, the employer must first determine if an injury or illness has occurred as defined by the applicable sections in the Cal/OSHA recordkeeping regulation:
14300.5; 14300.6; 14300.7; 14300.8 - 14300.12

No, if the employer is unsure as to whether an injury or illness has occurred, they may refer the employee to a physician or other licensed health care professional for their evaluation and opinion.

The employer may consider this opinion to help determine if an injury or illness exists.
