Subchapter 1. Rules of Procedure for Permanent Variances and Appeals from Temporary Variances
Article 1. General
§406. Party Status.
(a) Affected employees and/or an authorized employee representative may elect
to participate as parties at any time before the commencement of the hearing,
unless, for good cause shown, the Standards Board allows such election at a later
time.
(b) The Division shall be deemed a party to all variance proceedings before
the board, whether or not the division has appeared or participated in the proceeding
and shall be entitled to receive the same service and notice as any other party.
