INITIAL STATEMENT OF REASONS


INFORMATION DIGEST OF PROPOSED ACTION/PLAIN ENGLISH OVERVIEW

The Informative Digest contains occupational safety and health regulations which are building standards that must be codified in Title 24, Part 7 of California Elevator Safety Construction Code. The building standards, herein, will be identified by their Title 24 section numbers in BOLD type following the corresponding Title 8 regulations.

Article 13. Escalators
Section 3089(d)(1) Balustrades.

Existing section 3089(d)(1) specifies a solid balustrade shall be provided on each side of the moving steps. The balustrade on the step side shall have no areas or moldings depressed or raised more than 1/4-inch from the parent surface. Such areas or moldings shall have all boundary surfaces beveled unless parallel to the direction of travel.

The proposal will exempt balustrades equipped with brushes on escalators installed according to Section 3089(d)(6) from the requirement that no areas on the balustrade step side rise more than 1/4-inch from the parent surface. The paragraph is also reformatted to accommodate the exemption text.

Escalator owners may exceed the 1/4-inch raised surface limitation when brushes are provided. Reformatting the paragraph has no regulatory effect.

New Section 3089(d)(6)

Proposed new Section 3089(d)(6) will require escalator owners to retrofit existing escalators with brushes or sideplates between the escalator step side and the balustrade skirt guard to guard against accidental entrapment of body parts, clothing, shoes, etc.

New Section 3089(d)(6)(A)

Proposed new Section 3089(d)(6)(A) will require escalator owners to install a brush carrier that shall not rise more than 3/4-inch from the parent balustrade surface.

New Section 3089(d)(6)(B)

Proposed new Section 3089(d)(6)(B) will require escalator owners to submit to the Division the plans, drawings, and specifications on the proposed installation of the brushes or sideplates before the brushes or sideplates are installed. The Division shall review the plans, drawings, and specifications to ensure the installation of the brushes or sideplates and subsequent operation of the escalator do not conflict with other requirements of Article 13.

New Section 3089(d)(6)(C)

Proposed new Section 3089(d)(6)(C) will require the Division to inspect the brushes/sideplates for entanglement, entrapment, shearing, tripping hazards before the escalator is placed in service.

Article 14. Moving Walks
Section 3091(k)(1)(A)

Section 3091(k)(1)(A) specifies no areas or moldings on the treadway side of the balustrade be depressed or raised more than 1/4-inch from the parent surface.

The proposal will exempt balustrades equipped with brushes installed according to Section 3091(k)(4) from the requirement that no areas on the treadway side of the balustrade rise more than 1/4-inch from the parent surface. The paragraph is also formatted to accommodate the exemption text.

Moving walkway owners may exceed the 1/4-inch raised surface limitation when brushes are provided on treadway side of moving walks. The formatting of the paragraph has no regulatory effect.

New Section 3091(k)(4)

Proposed new Section 3091(k)(4) will permit owners of moving walks to provide brushes on the treadway side of the moving walks to guard against accidental entrapment of body parts, clothing, shoes, etc.

New Section 3091(k)(4)(A)

Proposed new Section 3091(k)(4)(A) will require owners of moving walks, who provide brushes on moving walks, to ensure the rigid mounting assembly for the brushes affixed to the balustrade not rise more than 3/4-inch from the balustrade surface.

New Section 3091(k)(4)(B)

Proposed new Section 3091(k)(4)(B) will require moving walks owners, who provide brushes on moving walks, to submit the plans, drawings, and specifications on the proposed installation of the brushes to the Division for review before the brushes are installed. The Division shall review the plans, drawings, and specifications to ensure the installation and subsequent operation does not conflict with other requirements of Article 14.

New Section 3091(k)(4)(C)

Proposed new Section 3091(k)(4)(C) will require owners of moving walks, who provide brushes on moving walks, to ensure the Division inspects the brushes for entanglement, entrapment, shearing, or tripping hazards before the moving walks is placed in service.
