Roll-Over Protective Structures (ROPS) for Equipment Used in Logging Operations
INITIAL STATEMENT OF REASONS
Section 6309. Canopies. Rollover, Jill Poke and Overhead Guard Protection.
Section 6309 contains regulations requiring the use of canopy protection for tractors, skidders, scrapers, motor-graders and front end loaders used to break lines or rocks meeting the specifications of the SAE Recommended Practice J-231. This section contains specifications for canopies and ROPS on equipment placed in service after April 1, 1971; canopy labeling requirements; use of deflector guards; jill poke protection; use of seat belts; and, use of forklift trucks in logging operations.
Subsection (h) mandates the use of seat belts meeting the requirements of the SAE J-386 standard for all equipment for which ROPS are required and employees are to be instructed in their use. This subsection also contains a "Note" clarifying to the employee that a body belt/harness connected to an inertia reel is acceptable in lieu of a seat belt.
A revision is proposed to delete the word "required" for replacement by the word "installed." The proposed revision will clarify to the employer that every piece of equipment where a ROPS is present shall have a seat belt for the employee to use, consistent with the intent of subsection (h). If there are any pieces of equipment currently in service equipped with ROPS but which do not have seat belts, those employers will have to install the required seat belt.
