Summary of Underground Construction (Amended) - decision after reconsideration

Pursuant to a Peremptory Writ of Mandate issued August 3, 2005 by Sacramento Superior Court, the Board set aside and vacated the Decision After Reconsideration issued October 30, 2001 and reversed the decision of its Administrative Law Judge issued on December 9, 1999. The Board found that the Division did not establish by a preponderance of the evidence violations of sections 1541(k)(1) and 1541.1(a)(1).
