Summary of FCI Constructors - decision after reconsideration

On, June 25, 2002, the Division requested a continuation of a hearing scheduled for the next day because it was unable to produce a witness; the request was denied that same day by the Executive Officer of the Board. On June 26, 2002, at the scheduled hearing, the ALJ granted the Division’s motion to withdraw the citations and issued an order to that effect. The issue on reconsideration was whether the order of the ALJ was a final order. The Board held that it was a final order.
