Summary of Davis Roofing – Decision After Reconsideration
         

Mail sent to Employer by the Board was returned by the Postal Service marked “Return to Sender [et al.]”  Employer’s address had not changed.  The Board held that due process requires a party to receive notice of Board proceedings, and failure of a party to receive such notice through no fault of its own requires reinstatement of an appeal.
