Summary of Jerlane, Inc. dba Commercial Box and Pallet – Decision After Reconsideration

The Board affirmed the ALJ’s Decision that Employer had violated the safety orders as alleged in the citations, including saw blade guarding (4306(a)) and training violations (3203(a)(7)). In doing so the Board also agreed that the ALJ had correctly rejected defenses raised by Employer, properly classified the violations, and denied penalty relief due to financial hardship was not justified on the evidence presented. Finally, the Board found that Employer’s “newly discovered evidence” was not “new” or “material”
