The Division established a violation of section 5193(d)(4)(C)2.a [closable container for regulated waste]. The issue before the Board was whether the contaminated waste produced in dental procedures is regulated waste subject to special handling. The Board determined that the gauze, cotton, and gloves were regulated waste because the contaminated waste appeared to be capable of releasing blood or other potentially infectious material. Therefore, pursuant to section 5193(d)(4)(C)2.a the regulated waste had to be placed in waste containers marked as biohazard containers, and Employers disposal of the waste into wastebaskets constituted a violation.
