Summary of Heat and Control, Inc. - Decision After Reconsideration
The Employer was engaged in Tungsten Inert Gas (TIG) welding. The Division cited Employer for non-compliance with the safety requirements of section 4853(d), which are applicable to "Inert-Gas Metal-Arc Welding." After thoroughly reviewing the history of section 4853(d) and relevant Fed/OSHA regulations and American Welding Society standards, the Board concluded that "Inert-Gas Metal-Arc Welding.", as used in section 4853(d), does not include TIG welding and upheld the appeal.
