OCCUPATIONAL SAFETY AND HEALTH
Summary of Tutor-Saliba Corporation - DAR
Employer's synthetic web crane sling was used frequently by Employer and other contractors at a multi-employer worksite. When not in use it was left hanging on a fence in direct sunlight. The Division cited Employer under section 5048(j) which prohibits use of such a sling where it is exposed to more than 150 degree heat or direct sunlight. Employer argued that "storage" means out-of-service for "days in a row." The Board held that the sling was stored when it was left hanging on the fence and that to comply with the safety order, a synthetic web sling must be removed from direct sunlight as soon as practicable after use and not re-introduced thereto until the next actual use.
