Summary of Pinnacle Builders, Inc. - Decision After Reconsideration

An employee was nailing sheets of plywood to roof trusses 19 feet 10 inches above ground without fall protection. The Division cited Employer for a violation of section 1670(a). The violation was upheld by the Board. Employer's contention that the work was a roofing operation covered by Article 30 (Sections 1723-1730), which requires fall protection above 20 feet was rejected. The roofing safety orders apply only to the work of installing and removing single-unit or multiple-unit roof coverings--the outer cover directly exposed to the weather--and the plywood sheeting is an underlayment upon which the roof covering is installed.
