Summary of Southern California Edison - DAR

An employee was cleaning an exposed 12-kilovolt wire. The foreman was 4' away with his back to the employee and was inserting a guy wire. Section 2940(d)(1) says that a qualified electrical worker must be in close proximity acting "primarily as an observer” when an employee works on exposed high voltage conductors. The Board held that the foreman was not acting primarily as an observer [can't be assigned any other tasks] so the violation was established. Since cleaning the wire required the employee to contact an energized high voltage conductor, the work was not excepted by section 2940(c) [replacing fuses, operating switches, work that does not require such contact].
