Summary of RFG, Inc. - DAR

Employer did not cover or provide guardrails at its car service pits when they were not in use. Cars covered the pits approximately 75% of the time. There was always an employee working on the shop floor around the pits. Employer trained employees to be careful around the pits and they wore slip resistant shoes. A violation of section 3212(a)(1) was upheld. Employees worked around the pits and were exposed. The pits were not protected by safety order means nor constantly attended "while the covers were not in place."
