Summary of Mackenzie Concrete – Denial of petition for reconsideration
The employer initiated its appeal 120 days late. The board sent a letter to the employer requesting an explanation for the late filed appeal and did not receive a response. The board then dismissed the employer’s appeal and the employer filed for reconsideration alleging that it did not respond to the board’s request in a timely fashion because they felt that they had already taken care of the problem. The board ruled that the petition for reconsideration did not satisfy any of the grounds enumerated in Labor Code section 6617 and affirmed its Order denying late appeal.
