Summary of Leo’s A-C, Inc. – Denial of petition for reconsideration
The appeals board issued an Order denying late appeal after the board found that good cause did not exist for the late filing of the employer’s appeal. Employer’s petition for reconsideration was filed over 10 months later. Labor Code section 6614(a) sets a deadline of 30 days after any final order of the appeals board for filing a petition for reconsideration. Longstanding board precedent holds that the board did not have jurisdiction to accept the petition and therefore it was denied.
