Summary of Mascon, Inc. – Denial of Petition for Reconsideration

Employer filed its appeal late due to a misunderstanding between their main office and the job superintendent over who was to prepare a response to the citations. The Board finds that the lateness was caused by Employer’s faulty internal operating procedures and holds that reason not to be good cause for allowing Employer to file a late appeal, citing Kaweah Construction Company 87-9005 and later cases. The petition for reconsideration was denied.
