Summary of California Quality Glass & Mirror Denial of Petition for Reconsideration
Based upon the statements attributed to an ostensible foreman, Employer was
found liable for failing to provide guardrails on an open side and end of the
top platform of a rolling scaffold which exposed its employees to a fall hazard.
Employers petition for reconsideration was denied. The Board reaffirmed
that the 30 day limit for an ALJ to issue a decision is directory and not mandatory
and that Employer in attempting to introduce new evidence, did not set forth
sufficient grounds to the Board warranting that the Board grant its petition.
