Summary of Steve Choate dba Paul Bunyon Tree Service Denial of Petition for Reconsideration
Employers worker who was not wearing head protection, was killed after he was hit on the head by a log thrown to the ground during tree trimming operations. Employer made generalized allegations, including that he had been denied a fair hearing and that the ALJ believed the wrong witnesses. The Board denied his petition because it did not satisfy the requirements of Labor Code section 6616 which provides that the petition for reconsideration shall set forth specifically and in full detail the grounds upon which the petitioner considers the decision to be unjust or unlawful and every issue to be considered by the Board.
