Summary of Teichert Aggregates - Decision After Reconsideration

Employer was cited for not training a newly assigned employee in the “standard procedure” for safely washing the windshield of the front-end loader. The employee had been shown how to wash the windshield by another employee. There was no proof that what the other employee showed him was not Employer’s “standard procedure”. The only evidence that it was not safe was the opinion of the Division inspector that lacked foundation—there was no evidence of his expert qualifications or vehicle window washing safety experience. Employer’s appeal was granted.
