Summary of Aluminite Northwest, Inc. DAR
The Board adopts and affirms the ALJs decision finding that Employers failure to guard the pinch points on a rigging table was a serious violation of section 4002(a) and that it caused a serious employee injury. An employees hand was caught in a pinch point and was severely damaged. The Division compliance officer testified to a substantial probability of serious physical harm or death. The unguarded parts were on a stationary shop machine in plain view so Employer knew or could have known of the violative condition.
