The division's contact person must receive all written comments concerning the proposed regulations no later than 5:00 p.m. on Monday, August 1, 2005. A notice of rulemaking after emergency adoption (official medical fee schedule - physician fees) was published by the state Office of Administrative Law on June 17, 2005. The proposed rulemaking is to permanently adopt the emergency regulations which became effective May 14, 2005. Workers' compensation proposed emergency regulation
The Office of Administrative Law (OAL) has approved the emergency re-adoption of the physician fee schedule regulations which adopt table A for services rendered on or after Jan. 14, 2005. OAL has also approved emergency adoption of a new table A for physician services rendered on or after May 14, 2005. The table A effective May 14, 2005 makes modifications to ensure that physician fees do not fall below Medicare rates. The emergency regulations also make technical corrections. The emergency adoption and re-adoption of these fee schedule regulations are effective on May 14, 2005. The division has 120 days to conduct a formal rulemaking action to adopt the regulations on a permanent basis. The regulations will remain in effect during the period OAL reviews the completed rulemaking. | ||||||

The OMFS table A emergency regulations were filed with the Office of Administrative Law (OAL) on May 4, 2005. This is a re-adoption of the table A effective 1-14-2005 and adoption of a new table A effective May 14, 2005. The regulations will not become effective until filing with the Secretary of State after approval by OAL. OAL has up to 10 days to consider the regulations, but may approve them before the 10 days have elapsed. Upon approval and filing with the Secretary of State, the regulations are effective for 120 days while the division conducts a formal rulemaking to adopt the regulations.
