The lien filing fee emergency regulation was submitted to OAL on December 30, 2003.
The Division of Workers' Compensation has requested an effective date of January 1, 2004
so that the regulation will be in place on the effective date of the new Labor Code Section
4903.05 which was adopted as part of SB 228. The regulation will not become effective until
filing with the Secretary of State after approval by the Office of Administrative Law (OAL).
OAL has up to 10 days to consider the regulation, but may approve it before the 10 days have elapsed.
Upon approval and filing with the Secretary of State, the regulation is effective for 120 days while
the division conducts a formal rulemaking to adopt the regulation. For information on the OAL procedure,
