A public hearing to consider proposed regulations implementing the supplemental job displacement benefit enacted as part of last year's Assembly Bill 227 has been scheduled for July 8, 2004 in San Francisco. The hearing notice material, including the proposed regulations and forms, have been posted at the DWC web site at: http://www.dir.ca.gov/dwc/DWCPropRegs//SupplementalJobDisplacementBenefitRegs.htm
The new benefit provides a voucher for education-related retraining or skill enhancement for eligible employees and replaces the vocational rehabilitation benefit for injuries that occur on or after January 1, 2004. The vocational rehabilitation benefit still applies to injuries that occur before January 1, 2004. For those injuries, services may be provided until January 1, 2009. The new voucher benefit is contained in sections 4658.5 and 4658.6 of the California Labor Code.
The public hearing gets underway at 10 a.m. in the auditorium of the State Office Building, 455 Golden Gate Ave., San Francisco, CA 94102. Written comment must be received by 5 p.m. on July 8.
