Division of Workers’ Compensation issues
15-day notice of revisions to proposed EAMS regulations
The Division of Workers' Compensation (DWC) has modified the proposed three
sets of regulations to implement the Electronic Adjudication Management System
(EAMS): court administrator regulations, Disability Evaluation Unit (DEU)
regulations and Retraining and Return to Work Unit (RRTW) regulations, and
posted a 15-day notice of revisions on its Web site. Members of the public
may comment on the revisions until 5 p.m. on Aug. 21, 2008. The proposed revisions
to the draft regulations include the following modifications:
- Minor changes in the format of the forms
- Clarifications regarding the filing requirements
- A uniform names requirement: In order to ensure case
parties and documents are accurately associated to the correct electronic
adjudication file, uniform names for claims administrators offices
and representatives offices (any office location for a law firm, lawyer
or representative of a party or lien claimant) shall be used when filing
documents in EAMS. The names will be assigned by the DWC
- If a document is not accepted for filing in EAMS,
the document will either be corrected, or a notice of document discrepancy
will be sent to the filer
- Once the claim has been accepted, only lien claimants
with a claim of $25,000 or more are required to appear at hearings. Lien
claimants not defined as a party with liens of less than $25,000 shall be
available by telephone with settlement authority
- An exemption from the regulations has been added
if a document is filed with EAMS as part of the electronic filing trial.
