Division of Workers’ Compensation files final regulations to increase the Official Medical Fee Schedule maximum reimbursable fees for evaluation and management procedures
The Division of Workers’ Compensation (DWC) has filed the final text of an amendment to the Official Medical Fee Schedule (OMFS) table A, which increases the maximum reimbursable fees for ten evaluation and management (E&M) procedure codes, with the Office of Administrative Law (OAL). The OAL will, in turn, file the regulations with the secretary of state and the regulatory changes will become effective Feb. 15, 2007.
Because Title 8, California Code of Regulations section 9789.11, “Physicians Services Rendered After July 1, 2004,” establishes or fixes rates within the meaning of Government Code section 11340.9 (g), the regulation is not subject to review by OAL. The text and the new maximum reimbursement rates are the same as were proposed in the notice of rulemaking, which was published in the California Notice Register on Dec. 29, 2006. A public hearing on the proposed regulations was held Jan. 24, 2007.
