Temporary total disability rate for 2006 will remain $840 per week

The maximum temporary total disability (TTD) rate for 2006 will remain $840. Labor Code section 4453 (a) (10), as amended by the 2002 reforms, discusses minimum/maximum TTD rates for injuries on or after Jan. 1, 2006 and states in part, “For injuries occurring on or after January 1, 2006, average weekly earnings shall be taken at not less than one hundred eighty-nine dollars ($189), nor more than one thousand two hundred sixty dollars ($1,260) or 1.5 times the state average weekly wage whichever is greater.”

The California state average weekly wage (SAWW) for the past 12 months was $838.42 – still below the $840 level. Thus, the 2006 TTD SAWW increase is not triggered.
