Physician fee schedule emergency regulations filed with Office of Administrative Law
DWC filed emergency physician fee schedule regulations with the state Office of Administrative Law on May 4, 2005. DWC has requested an effective date of May 14, 2005. The regulations re-adopt the emergency table A containing physician fees for services rendered on or after Jan. 14, 2005, adopt a new table A for physician services rendered on or after May 14, 2005, and make technical corrections. The table A effective May 14, 2005 makes modifications to ensure that physician fees do not fall below Medicare rates. The regulations as filed with OAL can be found on the DWC Web site at http://www.dir.ca.gov/dwc/dwcpropregs/OMFSEmerRegs2TableA.htm
OAL has up to 10 days to consider the emergency regulations, but may approve them before the 10 days have elapsed. Upon OAL approval and filing with the Secretary of State, the regulations are effective for 120 days while the division conducts a formal rulemaking to adopt permanent regulations. For information on the OAL procedure, and to learn how you may comment on the emergency regulations, go to the OAL's Web site at: http://www.oal.ca.gov/emergency.htm.
A notice will be posted at the DWC Web site when the emergency
regulations become effective.
