“If Your Employer is Illegally Uninsured:
How to Apply for Workers’ Compensation Benefits”
OAKLAND -- The Commission on Health and Safety and Workers’ Compensation (CHSWC) is pleased to announce the release of “If Your Employer is Illegally Uninsured: How to Apply for Workers’ Compensation Benefits.” The 60-page booklet was prepared by Institute for Research on Labor and Employment, University of California, Berkeley for CHSWC.
Employers in California are required to buy workers’ compensation insurance from an insurance company or become self-insured through a state program. If an employer is illegally uninsured and does not provide workers’ compensation benefits for a workplace injury, an injured worker may apply to the Uninsured Employers Benefits Trust Fund to pay those benefits.
The booklet provides useful information on reporting workplace injuries and applying for workers’ compensation benefits. It discusses 10 basic steps to apply for benefits if the employer is illegally uninsured. Among the important steps is determining whether an employer is lawfully insured in the first place and then making sure all the facts are documented for eventual resolution by a judge. The booklet is a resource for anyone who needs guidance in obtaining benefits, and it provides options for obtaining additional assistance; it is also a resource for anyone providing assistance on behalf of an injured worker. This booklet helps clarify the process of clearing obstacles and alerting the proper authorities about a potential claim and liability. CHSWC is charged with examining the health and safety and workers’ compensation systems in California and recommending administrative or legislative modifications to improve their operation. The Commission was established to conduct a continuing examination of the workers’ compensation system and of the state’s activities to prevent industrial injuries and occupational illnesses and to examine those programs in other states.
