SAN FRANCISCO -- California Labor Commissioner Jose Millan announced that the Division of Labor Standards Enforcement (DLSE) took swift action today to investigate a Koreatown restaurant after being informed that an employee of Cho Sun Kal Bi was allegedly fired for refusing to sign an agreement to have part of his wages paid in cash.
"Cash payment of wages without a paystub is not permitted under the law," said Millan. "An allegation of such blatant disregard for the law requires an immediate response."
The employer, Ed America, Inc. (dba Cho Sun Kal Bi Restaurant) was issued civil penalties of $14,000 for cash pay violations involving four other employees. Additionally, investigators found the owner in violation of laws requiring payment of a split-shift premium to employees. As a result, DLSE will conduct an audit of the employer's payroll records for the last three years to determine the extent of the alleged violations.
