Issue Paper on
Labor Code Section 5814
The enclosed "Issue Paper on Labor Code Section 5814" was developed by the Commission on Health and Safety and Workers’ Compensation (CHSWC).
CHSWC consultants prepared the Labor Code Section 5814 Issue Paper based upon research conducted in district offices of the Division of Workers’ Compensation and information received as a result of a ‘call for information’ to the workers’ compensation community.
At its April 2000 meeting, the Commission decided to approve the findings of the Issue Paper but to defer to the Legislature and the workers’ compensation community with respect to recommendations on the Labor Code 5814 penalty provisions.
